Terms of Use

1. General terms

These terms of use govern the use of the Elenord mobile application (hereinafter the “App” or “Elenord”).

Elenord’s developer and service provider is Tofix OÜ, registry code 14843268, Estonia.

By using or downloading Elenord, or by starting a subscription, you confirm that you have read and agree to these terms of use.

If you do not agree to these terms, please do not use Elenord.

If you use Elenord as a consumer, all mandatory consumer rights arising from applicable law apply to you in addition to these terms.

2. The Elenord service

Elenord is an electricity price application that allows you to follow electricity exchange prices and use features based on electricity price and energy market data.

The application may, among other things, allow you to:

• follow electricity exchange prices

• view energy generation data

• set electricity price based notifications

• use other features offered in the application

Elenord is an informational service. The information shown in the application is not intended to be the sole basis for financial, investment, energy purchasing or other significant decisions.

Tofix OÜ does not guarantee that the data shown in the application is always complete, accurate, up to date or available without interruption.

3. Electricity price and other data

Electricity price data originates, among other sources, from the public data sources of Elering and Nord Pool. For energy generation data, ENTSO-E Transparency Platform data is used among other sources.

The accuracy, timeliness and availability of third-party data sources are not fully within the control of Tofix OÜ.

Data may contain delays, gaps, technical errors or interruptions.

Tofix OÜ is not liable for damage arising solely from the inaccuracy, delay, absence or unavailability of third-party data, except to the extent that such liability may not be excluded or limited under applicable law.

Information from Elenord should not be used as the sole basis for significant decisions about electricity consumption or other expenditure.

4. Paid subscription and free trial

Elenord is a paid application.

A 30-day free trial is offered to users through Google Play. During the trial period the user has full access to Elenord’s paid content and features.

When the trial begins, a subscription is registered through Google Play, which includes the free trial and a subsequent automatically renewing paid subscription.

If the user does not cancel the subscription before the end of the 30-day trial, the free trial ends and a paid subscription begins at EUR 7.99 per year.

After the paid period begins, the subscription renews automatically for the next annual period until the user cancels it or the subscription ends for another reason.

Before the subscription is confirmed, Google Play shows the user the subscription terms, including the length of the trial, the price and the automatic renewal terms.

5. Cancelling the subscription

The user may cancel the subscription at any time through Google Play.

Deleting or uninstalling the Elenord application does not cancel the Google Play subscription. The subscription must be cancelled separately through Google Play subscription management.

Elenord provides access to Google Play subscription management for managing or cancelling the subscription.

If the user cancels during the free trial, no charge is made at the end of the trial and the free trial continues until its end, unless Google Play or applicable law provides otherwise.

If the user cancels an already paid subscription, automatic renewal is stopped. As a rule, access to paid content remains until the end of the billing period that has already begun. In certain situations Google Play may apply different cancellation or access rules in accordance with its own terms.

6. Payments and payment data

Purchasing a subscription and processing payments takes place through the Google Play billing system.

Tofix OÜ does not receive or store the user’s payment card number or other payment details that Google Play uses to make the payment.

In the Google Play purchase flow, the user authorises a recurring payment to Google and agrees to the Google Play terms of service. No personal data and no consent to process personal data is given to Elenord during this flow.

Elenord receives the technical data needed to manage the subscription through RevenueCat, including the purchase token, subscription and base plan identifier, subscription status, subscription-related dates, auto-renewal state and country code.

The user’s name, email address, payment card details or address are not passed to Elenord through this purchase flow.

7. Right of withdrawal and consumer rights

If the user enters into an Elenord subscription as a consumer, the consumer rights arising from applicable Estonian and European Union law apply.

For digital services, the consumer may have a statutory right to withdraw from the contract. Statutory exceptions and conditions may apply to the right of withdrawal.

Google Play refund and cancellation rules may additionally apply to purchases made through Google Play. Google Play treats digital services and digital content differently for the purposes of the right of withdrawal in the European Economic Area, and the exact procedure depends on the service purchased and the purchase flow.

These terms of use do not limit mandatory rights granted to consumers by law.

8. Availability of the service

Tofix OÜ makes reasonable efforts to ensure that Elenord functions as intended.

However, Tofix OÜ does not guarantee uninterrupted or error-free operation of Elenord.

The operation of the service may be affected by, among other things:

• internet connection problems

• problems with the user’s device or operating system

• failures of Google Play or other platforms

• interruptions in third-party services

• interruptions in electricity price and other data sources

• maintenance and update work

• other technical circumstances beyond the control of Tofix OÜ

Tofix OÜ may change, temporarily restrict or suspend Elenord’s features where necessary for maintenance, security, development or another valid reason.

9. Application updates

Elenord may update the application regularly to improve security, reliability and performance or to add new features.

Elenord also uses the Expo EAS Update service to update application content. Through it, certain application content and features may be updated without installing a new application version through Google Play.

Certain updates may be necessary in order to use Elenord. If the user does not install a necessary update or uses a very old application version, not all features may work correctly.

10. Intellectual property

Elenord’s source code, design, logo, graphical elements, texts and other application content belong to Tofix OÜ or are used under the relevant rights, and are protected by applicable intellectual property rights.

Without the prior written permission of Tofix OÜ, the user may not:

• copy or distribute Elenord’s source code

• modify or adapt Elenord or create a derivative application based on it

• reuse substantial parts of Elenord in other applications or services

• distribute Elenord or parts of it outside official application distribution channels

• reverse engineer, decompile or carry out similar activities in respect of Elenord, to the extent such activity is not permitted under applicable law

These terms do not grant the user ownership of Elenord’s intellectual property.

In the event of an infringement, Tofix OÜ is entitled to use the remedies provided by law.

11. User obligations

The user undertakes to use Elenord lawfully and in good faith.

The user may not use Elenord in a manner that:

• damages or may damage the operation of Elenord or its servers

• attempts to circumvent the application’s technical restrictions or protections of paid content

• places an unreasonable load on the service

• interferes with other users’ ability to use the service

• infringes the rights of third parties

• is contrary to applicable law

12. Liability and limitation of liability

Elenord is an informational application and it is used at the user’s own risk.

Tofix OÜ is not liable for damage arising from the use or non-use of Elenord, including differences in electricity costs or decisions made by the user on the basis of information shown in the application, except to the extent that such liability may not be excluded or limited under applicable law.

Tofix OÜ is not liable for failures caused by third-party services, data sources, application stores, the internet connection or the user’s device, except to the extent that the exclusion or limitation of liability is not permitted under applicable law.

This clause does not exclude or limit the liability of Tofix OÜ to the extent that such exclusion or limitation is not permitted by law.

13. Ending the service or the contract

The user may stop using Elenord at any time.

To end a paid subscription, the Google Play cancellation procedure described in clause 5 must be followed.

Tofix OÜ has the right to restrict or terminate the user’s access to Elenord where there is a valid reason, such as a material breach of the terms of use, abuse of the service or another basis arising from applicable law.

If Tofix OÜ ends Elenord’s paid service in a way that materially affects a subscription period the user has already paid for, the requirements arising from applicable law regarding notification, termination and possible compensation will be followed.

14. Privacy and personal data

When using Elenord, technical data and other data may be processed in accordance with Elenord’s privacy policy.

The privacy policy is available at https://elenord.ee/en/privacy

The privacy policy describes, among other things, the third-party services used in the application, the purposes of data processing, retention and the user’s rights.

15. Changes to the terms of use

Tofix OÜ may amend these terms of use where necessary, for example due to changes in Elenord’s features, the service, pricing or legal requirements.

In the event of material changes, users will be notified in a reasonable manner, for example through Elenord or by other suitable means.

Changes take effect from the date indicated in the notice.

If a change affects material terms of an existing paid subscription in a way that requires notification of or consent from the user, the relevant requirements arising from law and Google Play rules will be followed.

16. Applicable law and dispute resolution

These terms of use are governed by the law of the Republic of Estonia, except where applicable law provides consumers with mandatory rights or protection that cannot be derogated from by contract.

In the event of a dispute, the parties will first seek to resolve the matter by agreement.

The consumer has the right to use the out-of-court and judicial remedies available to them under law.

If a dispute cannot be resolved by agreement, it will be settled in the competent court in accordance with applicable law and jurisdiction rules.
